These Terms of Service ("Terms") govern your access to and use of tunetrolleypublishhouse.com and the products and services provided by Tune-Trolley-Publish-House ("TTPH," "we," "us," or "our").

1. About TTPH

Tune-Trolley-Publish-House is a private music publishing and creative-services operation that may provide access to original music, digital audio products, sample packs, music-production services, mixing and mastering services, and other related creative services.

TTPH may also use the website to display or showcase music and other works associated with TTPH.

TTPH may add, remove, modify, or discontinue products or services at any time.

2. Eligibility

You must have the legal capacity to enter into an agreement under applicable law to use TTPH's paid services and enter into transactions.

If you use TTPH on behalf of another person or organization, you represent that you have authority to bind that person or organization to these Terms.

3. User Accounts

Certain TTPH services may require an account.

You are responsible for:

• Providing accurate information;
• Maintaining the security of your account;
• Keeping your authentication credentials confidential;

5. Digital Products

TTPH may sell downloadable digital audio products, including sample packs, sounds, loops, presets, recordings, production resources, and related materials.

Unless a product-specific license states otherwise, purchasing a digital product does not transfer ownership of the underlying copyright or intellectual-property rights in the product to you.

Your purchase provides only the rights expressly granted by the applicable product license.

6. Sample Pack and Audio Product License

Unless otherwise stated in writing, TTPH grants the purchaser a limited, non-exclusive, worldwide license to use the licensed sounds and samples in creating new musical or audiovisual works.

Subject to the applicable product license, licensed sounds may generally be incorporated into original compositions and productions.

You may not:

• Resell, redistribute, sublicense, or commercially exploit the raw samples or sounds as standalone products;
• Repackage TTPH products for redistribution;
• Upload individual samples or substantially unmodified sounds to another sample library or similar service;
• Make the original or substantially unmodified samples available for extraction or download by third parties;
• Claim ownership of the underlying sample, recording, or sound itself merely because you incorporated it into another work.

The resulting musical work created using properly licensed sounds may be exploited by the purchaser subject to the applicable license and any other rights belonging to third parties.

If a particular product contains additional or different licensing restrictions, those product-specific terms control over this general section.

7. Music and Other TTPH Intellectual Property

Unless expressly identified otherwise, the TTPH website, its original music, recordings, compositions, artwork, logos, trademarks, written materials, sample packs, sounds, software, website design, and other content are owned by or licensed to TTPH or its respective rights holders.

Nothing in these Terms transfers ownership of TTPH intellectual property to you.

You may not reproduce, distribute, publicly display, sell, license, modify, or otherwise exploit TTPH-owned content except as expressly permitted by these Terms, a product-specific license, or a separate written agreement.

8. Studio and Creative Services

TTPH may offer services such as:

• Music production;
• Recording-related services;
• Mixing;
• Mastering;
• Engineering;
• Other creative or technical services.

The scope, price, deliverables, revisions, payment terms, ownership, licensing, credits, and other conditions for a particular project may be established through a separate written agreement, quote, invoice, work order, service agreement, split sheet, or other applicable document.

Where a separate written agreement applies to a particular service, that agreement controls in the event of a conflict with these general Terms.

9. Purchases and Payments

Prices displayed on the TTPH website are subject to change.

A purchase is not complete until the applicable payment has been successfully processed and accepted.

TTPH may use third-party payment processors to process transactions.

You agree to provide accurate billing and contact information necessary to complete a transaction.

10. Digital Delivery and Re-Downloads

After a successful purchase, TTPH may provide access to the applicable digital product through an account-based library, download system, email, or another delivery method.

TTPH may provide secure re-download functionality for previously purchased products.

Access to a purchased product may be restricted or suspended if TTPH reasonably determines that the account or product is being used fraudulently, unlawfully, or in violation of these Terms or the applicable product license.

11. Refunds

Because digital products may be immediately accessed or downloaded, refunds for digital products are generally not guaranteed after delivery or download.

However, TTPH may consider refunds or other remedies on a case-by-case basis, including where:

• A product was materially defective;
• A duplicate transaction occurred;
• TTPH is unable to provide the purchased product;
• A refund is otherwise required by applicable law.

Nothing in this section limits any non-waivable consumer rights provided by applicable law.

Any service-specific refund or cancellation terms contained in a separate written agreement will apply to that service.

12. Prohibited Conduct

You may not use TTPH services to:

• Violate applicable law;
• Infringe intellectual-property rights;
• Commit fraud or facilitate fraudulent transactions;
• Circumvent security or access controls;
• Attempt to obtain unauthorized access to accounts, systems, or databases;
• Interfere with the operation of the website;
• Distribute malware or malicious code;
• Abuse download or re-download systems;
• Share account credentials for the purpose of circumventing purchase or access restrictions;
• Redistribute TTPH products in violation of their applicable license;
• Misrepresent your identity or affiliation with TTPH;
• Use automated systems to abuse or overload TTPH services.

TTPH may take reasonable action in response to suspected abuse, including restricting access, suspending accounts, or terminating services.

13. User-Submitted Material

If you voluntarily submit material to TTPH, including messages, feedback, suggestions, project information, or other content, you retain ownership of your intellectual property unless otherwise agreed in writing.

TTPH does not obtain ownership of your creative work merely because you submit it through the website.

Any ownership, licensing, publishing, production, or other rights concerning a creative project should be established through a separate written agreement where appropriate.

To the extent legally permitted, disputes arising from these Terms or your use of TTPH services shall be brought in a court of competent jurisdiction located in Miami-Dade County, Florida.

TTPH's failure to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.

These Terms, together with any applicable product license, service agreement, purchase terms, Privacy Policy, and other written agreements expressly incorporated into a particular transaction, constitute the applicable agreement between you and TTPH concerning your use of the relevant service.
